Can I be convicted of a armed robbery charge with the only evidence being just 2 people saying I did it?
Question Details:
A year ago my boyfriend was blamed for a armed robbery. He was not arrested on the spot or found with a weapon on him when he was arrested. They don't have any evidence besides 2 people saying it was him when there was 5 people involved. The 1 of the 2 blaming him got arrested recently for a gun charge and the fingerprints on the gun were not his. Can he be convicted ?
In criminal cases, it is not a matter of how many witnesses or how much much evidence. It is about proof beyond reasonable doubt. With two witnesses, if the prosecution can convince the judge/jury beyond reasonable doubt, then yes your boyfriend could be convicted. Remember Scott Peterson? There was no murder weapon. The body was never found. But he was convicted of first degree murder.
