Can I be charged with possession of marijuana based on a rumor?

Question Details:

I'm 19 and I was at a party where there was drinking going on. The cops apparently saw beer outside and raided the place. I do not live there. The room upstairs got busted and they found paraphernalia a scale and some weed. The owner of the room admitted the stuff was his except for some pot. The cops asked him who it was and he said he didn't know. A rumor is flying around that it's mine. Can I actually be charged?

Criminal Defense Law Answers

Police officers may charge people with crimes as long as they had probable casue that you committed or are in the process of comitting a crime.  Probable cause requires a police office to articulate  reasonable facts and circumstances that would reasonably lead an officer to believe that a crime was committed or is in the process of being comitted.  If you have not been charged by now, then you may not have anything to worry about.  Rumors are generally not sufficient to arrest someone without some reliable facts.  Therefore, you should not have to worry.  However, if you are arrested, you need to hire a lawyer and not speak to the police as possession is taken seriously in most states.
