can an uninsured driver make a claim against an insured driver in Texas?

Question Details: We are insured, and my husband backed into a parked car at 1 a.m. this morning. This was in a stadium parking lot and the owner of the other car was present. A police report was taken, but insurance forms were never requested of either driver. I am starting to suspect the other driver is uninsured due to some strange phone calls we've received (I haven't heard from the insurance co), and husband has had a call at work claiming to be from insurance co, but he didn't give his work number last nite. Their car was damaged, ours was not.

Auto Accidents Law Answers

I am not familiar with Texas law, but generally speaking if you are at fault in an auto accident, you are still liable if the other driver is uninsured.
