Can an engineering and construction management company be held liable if you are injury on a construction site?

Question Details:

Every morning before driving up to our point on the bridge we must first check and sign in with the TBTA. One of the engineers from the Liro Group never checked in along with a subcontractor who he was riding with. While we were on the bridge to be dropped off the subcontractor slammed into us. So basically can the engineering company be held liable as well as the subcontractor for not checking in with security?

If a correct cause of action is applied there may be liability that extends beyond the subcontractor.  The theories can stem from negligent oversight, negligent security, etc.  The tension will be what the working relationship is between all the parties and what degree, if any, will worker's comp play in the equation.  We handle cases where we examine liability of all the parties and review the injuries and accident in the context of the NY labor code, to see if there is any way to bring third party liability claims and litigate the matter outside the realm of Worker's Comp.  Please call us at (212) 725-7272 to discuss your matter free of charge. bbpc-law.com
