Question: Criminal Defense - Pennsylvania

Asked on 8/6/2009
Can a summary offense be expunged. Will a $4.00 retail theft show up on a job application?
My son in 2007 committed retail theft for $4.00 - $5.00 and plead guilty in magisterial court. It is listed as a summary offense. Can we try to have this expunged? When employers are checking backgrounds, will it appear? Thank you very much.

You can get it expunged because it is a summary offense.  The only problem is that you have to wait five years before your son is eligable for expungement.  I hope this helps.  Should you have any other questions please feel free to contact me at 215-825-5183.
