Can a settled bankruptcy be amended to add a creditor that was originally agreed upon to not file against?
Question Details:
Once a debtor has received his or her discharge in a bankruptcy under federal law the bankruptcy cannot be reopened to add a creditor that was not initially listed in the pleadings and upon the debtor's schedules. As such, the debtor will need to resolve the issues as to that creditor outside of the bankruptcy forum.
