Can a laywer help me recoup the diminished value of my car? Should I contact the other insurance company directly or through a lawyer?
Question Details: I dropped my car off at the dealership for regular maintenance, and while out for a test drive the dealer was in an accident. The other driver was found at fault, and their insurance paid for the repair work, but now I am stuck with a car that is worth less than half its value compared to when I dropped it off. The dealer will not recognize the prior value, and will only offer me a trade in if I can put money down. They said to call the other insurance company directly, even though I have had no contact with them before. I do not know what to do, and no one is offering the right kind of help.
You may be able to bring a claim for diminished value in small claims court or your district court.
