Can a friendkick you out with no notice if you have an oral agreement and have paid the bills?
Question Details:
I have lived with a friend of mine for several months with my 2 children. He moved out and said the kids and I could live their as long as I needed and as long as I continued to pay the rent and electric, which I have. Can he kick us out thus making us homeless?
If you have an oral agreement with your friend to live in the unit that you are living in with your children where you pay utilities, under the law the rental is deemed to be a month-to-month rental.
Unfortunately, your friend can serve you with an oral notice of termination of your tenancy (30 day notice) to place you on notice that your rental will be up in the next 30 days. If he does the proper procedures he can have you vacate the rental with your children.
