Can a finance company that we owe money to levy our tenants personal property?
Question Details:
We rent out our property to different construction company's. The sheriffs department came to levy our personal vehicles but levied our tenant's equipment and their personal tools, etc. What can be done to stop the harassment of our tenants? We have lost 2 tenants because of this mess. How can they levy someone else's equipment?
Answer: they can't do this. If A owes money, under the right circumstances, A's property can be taken--but not the property of B, C, D, etc. It's probable that the Sheriff's dept. doesn't believe that this was someone else's property--they probably think it was really yours. Since this is very serious--loss of income; damage to business reputatio; possible liability to your tenants--you should retain an attorney; provide the attorney with all possible evidence of who owned this property; and have the attorney help you not just stop the ongoing harassment but look into what claims or legal actions you could bring against the Sheriff. Good luck.
