Can a credit card issuer garnish your wages if your account has been written off?
Question Details:
I am employed in DE but my credit card has been written off to a collections deptarment (litigation/law firm)? Can they garnish my wages if I make small payments they asked for. Or should I leave it along because it is already on my credit?
If it was sent to collections it hasn't been "written off"--when a debt is written off, it is classified as uncollectible and the creditor takes a tax loss on it. If it's in collections, they can sue you for the debt, and if they win, they can seek a judgement letting them garnish your wages. They are no obligated to accept partial or small payments, though they certainly may be willing to work out some payment scheme with you. Whether you ignore it or not depends on how willing you are to risk having an actual legal judgment against you and possible wage garnishment.
