Can a collection agency take my mother's pension?

Question Details: My 83 year old mother was subpoenaed by a credit collector. My mother has had a series of strokes and her mental capacity is diminished. She says she went to court because she had to because the man told her to. At court, they told her to give them $200 to continue and she did. She only told us today and court is next week. She owns nothing, has a small pension and social security. She is afraid they will take her pension and when she dies, my father will have nothing but his $600 SSI payment.

Social Security, pensions and retirement accounts are exempt from collection in IL.  If your mom owns a home, a memorandum of judgment could be filed on the home.  Any money in a bank acount in her name could be subject to garnsihment.  Please feel free to contact me for a Free Consult.
