Can a car be sold off a lot without a valid inspection?
Question Details:
Mydaughter bought a 1996 Nissan Altima from a used car dealer. After getting the car looked at by a mechanic we were told of several things on the car that would need to be fixed eventually. The biggest is the front brakes. After talking to the dealer I found out the car did not have a valid inspection. My question is, was it legal for him to sale a car with out the inspection being up to date? Also, he stated that the only repairs he would do would be the ones that would get the car to pass inspection. Two repairs he already knew about, the third is the front brakes.
I am a lawyer in CT and practice in this area of the law. It is common for dealers to sell used cars "AS IS." this means that the car has no warranties of fitness or guarantees that the car functions properly. I would need to see all the documents that were signed in connection with the sale of the car as well as all work performed on the car. you may have a manufactures warrant claim that you may assert or another claim against the deal. however, having purchased a car that was not inspected may not be sufficient to make a claim against the dealer without a lawyer looking at the documents you signed to be sure. make an appointment with a lawyer as most will meet with you initially for free.
