Can a business bill for services retroactively after the inittial invoice is paid in full as a form of retaliation?

Question Details: My wife and I hire a business to handle flowers, photography, and transportation for our wedding, right before the ceremony his camera died and he was unable to take pictures, he took off and didn't come back. We sent him aletter of demand requesting the full photograhy portion of the package back since he was only willing to refund $1600 of the $3000, his response was to threating to bill us for "cosultation services" retroactively, is this even legal?
