Can a bank report your car stolen if they are trying to repossess your car?

Question Details:

I have a car loan through a credit union and I was unable to make payments for a while. i have now been dealing with all of my credit card companies, settling out. Now I was about to start calling about my auto loan when I received a voicemail saying that if they don't the truck back within a few days they were going to report it stolen. can they do that? I have not received anything in the mail saying that they were going to report it stolen, is this a threat or can they do this? i live in San Diego ca.

I would strongly urge you to consult an attorney with the voice mail. While they can initiate an action against you and move to repossess the car I have never heard of a creditor on an auto loan reporting a car stolen for lack of payment. This sounds extremely strange as I really would think your best served to consult a local attorney with the actual voice mail to ensure there were no laws broken by the voice mail left.
