Business trying to collect from client
We are a Property Preservation business located in Michigan, One of our clients has not payed us in weeks (months). We perform maintenaince work on foreclosed homes for this client and they owe us in excess of $90,000.00. The client is located in Texas. We have been calling and speaking to the clients owners and accounting department only to be promised payment and never recieving it. They have recently stopped answering our calls and emails. We would like to know what our best course of action would be.

At this point, if they steadfastly will not pay you, your best course is to sue. If you win and get a judgment and they still don't pay, you can try to attach any bank accounts or put a lien on the foreclosed homes you maintain, so that they cannot sell them w/out you receiving a share of the proceeds.

Under Michigan law, you may be able to file liens against the homes that you worked on depending upon your agreement, licensing, etc.  Then you may sue to foreclose the lien and sell the homes at auction for you to be paid.  Contact me to discuss in further detail John Tatone 586-868-5100
