What can I do if my builder is over a month past due on completion date?
Question Details:
Builder is over a month past due on completion of my new home according to completion date set in contract. As a result, my family is displaced. He provided a POD storage for our things, but we can't get to anything we need to function properly. It was supposed to be for 2 weeks, now it has been 1 1/2 mos. He is horrible about returning calls. The neighbor across the street from the home tells me that crews have been there everyday, but I don't see any progress being made. He has several projects going on at once and I'm afraid my home has been placed on his back burner.
You have the options to terminate the builder and replace him with another contractor that can timely complete the work. you are able to then sue the contractor for the extra money that you had to pay to complete the project at your home. you should not have to tollerate a builder that is focussing on other projects and not complying with his obligations under the contract. I suggest that you review the contract to determine whether you need to provide written notice of temination under the contract. if no such clause exists, then you should send the builder a certified letter terminating him and locating a new builder to complete the job. I would have a lawyer send this letter if you can as it will make the best sense.

Are you a lawyer?
