Can I return a car withing 72 hours of purchase?
Question Details:
This car is in a major recall because its dangerous. I signed papers titles, etc. yet no money has been exchanged, and the papers I did sign were for a different financial institution, payments, term, etc. Upon signing the dealer told me that he can't get these payments, that I can walk away no questions asked. Now that I found out about the recall, I don't want the car and he said that since he found a bank that will give me lower payments, term, etc. that I have to take the car because I signed the papers. I told him no I want my car back and I'll give them theirs. Can they do this? Do I have some kind of 3-day right to rescind the transaction?
Iowa does not have a 3 day right to cancel a contract in the purchase of a car from a dealer's lot. You seem to have a great deal of things that went on with the pruchase from the time the papers were signed until now. I would strongly suggest that you take the paperwor to an attorney to review. First, you appear to be saying that you have no contract because of the tems: financial institution, etc. ANd then you have the issue of the car's safety (is it Toyota? ) and how dealerships have been dealing with that issue has been very different than regular recall issues. I would contact yout State's Attorney General's Office as well. There is a COnsumer Protection Division that could possibly help. Here is the link: www.iowa.gov/government/ag/consumer
