Question Details: my ex husband and I were married over 20 years divorce about 2 years ago. He passed about 3 weeks ago and I was still the beneficiary of his life insurance policy the insurance company called me and now they are saying that because we are divorced it will go to the 2nd beneficiary which are the grown kids they also said that law is only in New Mexico and Montana is this true or do they have to pay me the money
I'm not at all sure about that being the law only in those two states, although I've never had to deal with the question directly. This result doesn't surprise me at all.
Once you were divorced, you no longer had any "insurable interest" in your ex-husband's life (although in some high-income cases, a life insurance policy can be used to guarantee support payments, but that has to be specified in the decree); after the divorce, you would not have been allowed to take out a policy on him.
