Question Details: I was involved in a 9 vehicle accident. I was the back vehicle and only involved with the vehicle directly in front of me and the police report supports that. The collision was 15mph. My insurance company went to arbitration without my knowledge and said that I was responsible for the damage to 2 other vehicles that I was nowhere near. I disagree 100% and have made complaints about my adjuster in the past. Can it go to arbitration without my knowledge or presence? What are my options to fight this? Thank you
Without at the very least reviewing the police report, there's no way to evaluate what the insurance company did here. It might have been entirely appropriate, or not, or not at all.
I'm not a Colorado attorney. But in most states, when your insurance company takes on a claim against you, pays for the attorney and is ready to pay your liabilty (whether after trial or by settlement) up to the policy limits, they get the right to control your defense.
In many states, arbitration and similar processes are used to resolve cases more quickly and with less expense than a full courtroom trial.
