Question: Bankruptcy - New York

Asked on 11/6/2009

Back wages and bankruptcy

The company that i worked for owes me back wages but filed a Chapter 7. So, I plan on writing to the bankruptcy court on like a bi-weekly/monthly basis and should I attend the hearing scheduled as well? Would I make an attempt to speak about my claim at the hearing?

There is no reason to write to the bankruptcy court (in fact, it's completely inappropriate).  If there are going to be assets distributed in the chapter 7 case, you will be notified by the Trustee to file a proof of claim, which you should then do so that you get paid whatever portion is available after liquidation to pay your class of claims.   You have a "priority" claim of up to $10,950 for wages earned within 180 days prior to the chapter 7 case being filed.  You may want to contact the case trustee to see if there will be any assets liquidated.
