Question: Auto Accidents - Florida

Asked on 7/31/2009
Automobile vs a motorcycle. How much can i expect for pain and suffering due to this accident. naturally I was riding the motorcycle.
A car being driven by an 18 year old male crossed my path twice within a few seconds. First right to left and second left to right striking me in the left side of the bike. knocking me down resulting in no broken bones only scraps and bruises.

It sounds like the physical injury wasn't all that bad, and I'd assume there is no permanent loss of function and no disfiguring scars.  So there isn't a lot of pain and suffering to be had here.

Exactly how much, I couldn't say without reviewing your medical records, and without knowing the court where your case would be tried (which I don't).  The settlement value of a given injury can vary quite a bit from one place to another, even within the same state in some situations.  For reliable advice, you'll have to talk to a local attorney.

Florida law requires a "serious injury" before you can be compensated for pain and sufffering in a motor vehicle accident.  Serious injury is defined in the Florida No Fault Law.  It does not appear you qualify.

I must disagree with the previous comments, as you should qualify under Florida law for compensation for your injuries since you were on a motorcycle. Please feel free to contact me and I'd be happy to talk to you more about your case. 800-655-4529 or 954-515-5000. - Jason Turchin
