Car damaged in a parking garage out of my home state, how might I handle this case?
Question Details:
My car was parked in a garage out-of-state and when the car was retrieved it had additional damages to it (other than those already on it). Upon speaking to security and valet managers they showed me photos taken upon arrival and departure and they had nothing indicating the damages did not occur on their premises. However, now months later, I am being told that the insurance company is denying the claim. What can I do?
You can sue them. You'll have to file the suit in the state and county where the garage is located, most likely. One place to look for attorneys in other states is our website, http://attorneypages.com
When you park your car in a garage like this, especially if it's valet parking, the legal relationship that's created is called a bailment, where the garage has temporary possession of your property. Especially in this situation, where the party that has possession temporarily benefits from the bailment (you pay for the parking), the law imposes a fairly strict responsibility to return the property undamaged, or be liable to the owner.
