The auto driver certainly can be sued if he or she failed to operate the vehicle with the appropriate standard of care.  If the driver is on the cell while backing up, it is a strong indication of negligence.   You should speak with a professional before making any statements to either sides insurance company, so your rights are preserved.  Please call us 24/7 at (800) 9100-LAW, (800) 910-0529 to discuss the case free of charge.  There is no fee unless we recover money for you.  bbpc-law.com

The driver can be sued for causing your injuries.

Did the police respond to the accident?

Did the driver admit to backing up and being on the phone?
