Auto accident settlement - can I get more?

Question Details:

In car accident but it was not my fault. My car was totaled by the other drivers insurance. It sells for about $10,000 and they offered me $8,500 and I accepted it. I am having trouble finding a car that is comparable to mine for that much money. I have not signed anything; haven't even endorsed the check. Is it too late to ask for more money? Should I get a lawyer to help?

I am a lawyer in CT and practice in this area of the law.  your verbal acceptance of the check may be enough to prevent you from seeking more money.  however, since you have not yet taken the funds intou your account, you may be able to have a lawyer squeeze some more3y money out for you.  i suggest that you try to use a lawyer, however, the lawyer's fees that he will take will reduce any money you get down to what you have now.  so, i do not think as a practical matter, that you will come out better than you have.  neverthess, the choice is your to try to get more.  indeed, you may be able to get money for pain and suffering if you have any hospital bills.
