Auto accident claim denied. AAA said insured's son excluded from policy.
Question Details:
When insured's son was a teenager, AAA was going to raise rates if son stayed on car policy, this was 10 years ago. So insured signed exclusion clause for son to be excluded. 3 vehilces later, son is 28 married and out of home long time. Insured let son drive vehicle and an accident occurred. Slick road, rainy single car accident. They have full coverage and each policy renewal for new cars does not stay any exclusions. Insurance claims denied their claim do to exclusion of son 10 yrs prior, can that be? Are exclusions carried over to each renewal of policy and even to new vehicles? Or not?
I'd have to read the actual exclusion clause signed by the insured, to have an opinion on this one. It may be a simple-english question, based on the document -- or maybe not. There's a very substantial body of case law about insurance, and it tends to favor coverage.
You need to pursue this with a local attorney. He or she will be able to make the insurance company produce the signed exclusion, if that is what they are relying on.
