Auto Accident at a T intersection

Question Details:

I was driving my friends car up a hill that T's with another road. There is no stop sign so I looked down either direction of the road and continued driving without stopping. A car driving down the road going from right to left appeared from behind a parked car and I crashed into the passenger side of the car turning right. Am I fully at fault?

Auto Accidents Law Answers

In these kinds of cases the attorneys who evaluate these kinds of accidents apply what is called the "reasonable person" standard because that is what an arbitrator or jury would be required to do.  The "reasonable person" is basically a fictitious entity that would act reasonably in any given situation.  Based on the facts of your question, one would have to decided if the other driver could have done something that a "reasonable person" would have done in order to help avoid the collision.  The same standard would apply to you.
