In accident and car totaled but insurance award not enough to replace my car, what other options do I have?

Question Details:

I was stopped at a light when a pickup rear-ended me. I was slammed into steering wheel. Went to emergency for cat scan which came out OK. Now, however, insurance wants to total car and pay me $3500 which is not enough to purchase a new vehicle. Although my car was 20 years old it was in perfect condition and had only 100,000 miles. Do I have any other options here? Can I file suit for car damages?

The car that hit your from behind is likely going to be found at fault for drving too closely.  Are you injured?  If you suffered injuries in the accident such as whip lash or a back injury you should go to the hospital.  often times, injuries do not surface until several weeks post accident.  In you case, you should go to the hospital for a check up or visit you personal care physician.  If you have some pain and suffering from the accident, you may be entitled to sue for your medical bills and be awarded pain and suffering.  While it may nbot be a lot of money for pain and suffering it might just be enough to give you enough money to get a new car.  the insurance company, despite the good shape your car is in, is only required to give you the fair market value of your car.  i suggest hiring a lawyer to sue for pain and suffering to have a chance at obtaining more money to compensate you.
