As a former employee, can I create a new version of a software application and sell it?
Question Details:
I left a utility company 6 years ago. While there I worked on a web application that was used internally. They did not sell it. I am creating an LLC. Can I create a similar application with similar functionality and sell it? I would be creating it from scratch but it will have some similar features like financial/billing cycles for payments and bills.
At first glance, there are several issues for us to consider...(1) did you have any written or "understood" agreements as to any restrictions for you after you left employment; (2) we will need to explore if the new application is a result of your work there or (3) a derivative product.
