Are you able to contact a public defender before your court date, or do you have to wait until the judge deems one for you?

Question Details: I was arrested for an aggravated DUI 1st offense and speeding with no insurance with me. I do in fact have insurance but the card was left at home. I've had a clean record up until this point with a TS clearance the last 4 years while I was in the military. I made a block sheet to where I've attended AA meetings since the incident last Friday. I cannot afford an attorney b/c I just got out of the military and have not found a job yet. What am I likely to receive reguarding charges with a public defender?

I am a lawyer in CT and practice in this area of the law.  The time to ask for a public defender is at the first court appearance.  You will have to explain to the court that you would like a continuance to obtain and complete an application for a public defender. The court will give you a few weeks to apply and retain a PD.After the court grants you a continuance, go to the PD's office in the court house and apply for a PD.  you will know that day if you qualify.  you are facing a charge that will likely result in a dismissal if you complete some alcohol classes.  however, you should have an attorney to represent you to make sure you get into this program.
