Are braces considered a unreimbursed medical expense?
Question Details: My ex refuses to pay for them he is required to pay 75% of unreimbursed medical expenses I had them applied four years ago to my daughter's teeth. I asked his opinion on the subject prior to having them applied and he wanted to get a second opinion but months went by and he never did. He thinks they are a luxury. Meanwhile he makes significantly more money than I do. I have paid 100% of the cost and in the 4 years since they've been applied removed two years ago he has not paid anything towards the braces. Will a court make him reimburse me?
You cannot sit on this...the statute of limitations could lapse. If he has a court divorce and support decree requiring him to pay unreimbursed medical expenses, then you need to file in court to show he is in contempt of the order and require him to pay his portion of the braces. Braces are not usually covered by insurance. It makes no difference if he considers it a luxury.
