An insurance company sued me for $150,000 after i paid the people i hit $2400! They have had my license suspended for 10yrs now how do i get them back
Question Details: I was in an accident ten yrs ago with no license no insurance! The court ordered me to pay the people i hit $200 a month for 12 months a total of $2400! I paid it! One year later the insurance company sued me for $120,000! I did not appear at cout and the judgement was granted to them! Then they suspended my license just as i was getting them back! My question is how long can they keep my license and how can they keep my license from me for this? What can i do to get them back?
Thank you for the question. Unfortunately, you really created a mess for yourself by not appearing, and so much time has passed that it is unlikely that a court would vacate that judgment at this time unless you were not properly served in the original case.
This is a ciolation of the Financial Responsibility Act. I know of one option for sure, and that is to enter into some kind of payment arrangement with the insurance company. Otherwise, it may be possibe that you can discharge the debt in bankruptcy. However, I am not a bankruptcy attorney and suggest that you consult with one if you do not want to make some kind of payment arrangement with the insurance company. good luck.
