Breach of contract
Question Details:
An Ad Agency hired my husband and I to host a party for their client on Halloween. They claimed we broke the signed contract, when we in fact did not. They are trying to deduct our pay, as well as make us wait until 11/15 before they write the check. They also told us they would send check in mail because that is the only way they can pay their people, even though they do not have our address. Is there anything legally we can do to get the full payment, or at least any payment from this agency? I fear that they will not pay us at all being they are making us wait so long and giving us this story.
I'd start out by making sure that you can prove, in writing, that the agency has your address, although how that didn't get included in a written contract, I'm not at all sure. However, payment on commercial contracts within 30 days isn't at all unusual, so the two-week delay won't get you anything unless the contract specifically said you were to be paid sooner.
Breach of contract is something that gets decided by courts all the time. If you aren't willing to settle for what they do pay you, or if they don't pay you at all, the only thing you can do is sue them.
