Am I entitled to full refund if I purchased a computer as new when in fact it was refurbished?

Bought a computer on-line from a major seller. Computer described as new but it developed fault; I was told by service technician that was factory refurbished model. I was also informed that warranty was only 90 days and it had run out 3 months prior. Computer could be repaired for $320. I said no and charged $80 to get computer out, even though it was not fixed. Seller has offered to fix if sent back in original box and packaging and that I pay for postage both ways. I am annoyed to being misled and feel I should get refund or new machine. What are my rights?
Your agreement to purchase the computer was a contract and from what you have written it appears that the contract was breached. It sounds a bit like consumer fraud as well and the state attorney generals office should be able to help you with that issue. You need to contact them regarding the computer and see if they can contact the seller. If the seller is not the manufacturer would also contact the manufacturer and let them know that this is going on and see if they will step in. They don't want their product name dragged through the mud. Your final option is, of course, to sue them in small claims court. Good luck.
