After a divorce is final, can I collect on my ex-husband's father's life insurance policy that we paid into?
Question Details:
Divorce was final 01/26/10. My father-in-law passed away less than 24 hours later. We paid into a life insurance policy for the father (along with my ex-husbands sibliings) for 3 years. Am I entitled to any of that money?
In order to receive the benefits under a life insurance policy you need to be the beneficiary. The life insurance company is only required to pay the people that are listed on the contract a beneficiaries. If you are not a beneficiary on the insurance contract, then you are not going to be able to make any claims. Why was this not discusses in the divorce? Did you have counsel? I suggest that you obtain a copy of the policy and hire a lawyer to review whether or not you are barred from receiving the benefits under the contract. Since you no longer are related to this person and are not on the contract you are likely not able to get the money you paid into the policy.
