What to do if a false offer of employment?
Question Details: About 10 to 20 people were hired at a restaurant appoximately 1 month ago. The opening date was to be the 1st of this month but kept getting put off. Now no one associate will answer anyones calls or message; rumors are circulating that they are having serious issues with their liqour license. We have all signed an employment agreement and filled out W4's and were previously given schedules. Many of us had turned down other jobs due to the false statements this company has made. Can we sue for lost wages?
Filing out a W4 is irrelevant, but anyone who signed an employment agreement with a definitive start date may be able to sue for breach of contract. Anyone who turned down another job IF this employer knew the prospective employee had another job or job offer and knowing that, noneless made a job offer, might also be able to sue, based on the theory of "promissory estoppel." Other than as above, an employer may rescind a job offer, however.
