Can I have my divorce papers amended to no longer include private school tuition since public schools exist?
Question Details: A year ago I filed for divorce. In those divorce papers I agreed to pay for private school for my daughter who is 3. She has not been accepted to nor does she currently attend private school. Since my divorce, my financial situation has changed and I have filed Chapter 7.
What you are really asking here is for a modification of the agreement and order due to a change in circumstances ( losing your job is a change in circumstances). If your ex will not agree to do so voluntarily I would seek help and come up with a plan as to which schools are available, their stats for reading, writing and math (generally state testing scores), etc., to show that there are alternatives to the private school.
