A will written in N.Y. is it recognized in Delaware?
Question Details: Our mother is dyeing and she got an amended will done in 2003 in New York, naming my brother as executor. Is that will binding in the state of Delaware?
I am not admitted in Delaware but it is my understanding that as long as the Will was validly executed in accordance with the laws of the State, it can pass state Lines. So yes, it is valid if you are intending on probating it in Delaware. I am assuming that Delaware will be her "domicile" at the time of her death. Domicile is different from residency. Domicile is a person's usual and permanent place of residence.
