A surgeon performed surgery and then told us he doesn't accept our insurance after the fact, what are our legal rights?
Question Details:
After an accident the hospital took our insurance information then the surgeon performed the surgery. After the fact the surgeon told us we had to pay because he doesn't accept Blue Cross Blue Shield.
This happens all the time when a person is taken to a participating hospital and treated by a non-participating doctor. You are covered by your insurance. If you went to the hospital due to an emergency situation and were treated at the hospital for injuries Blue Cross Blue Shield should indeed cover his services. Contact Blue Cross Blue Shield and advise them of the situation. You can not be expected to interview every doctor in an emergency situation to insure that they take your insurance. And the hospital was indeed aware of your insurance limitations. Don't take no for an answer. Good luck.
