A SMOOTH DIVORCE, IS IT POSSIBLE?
Question Details: MY HUSBAND AND I HAVE BEEN SEPARATED (NOT LEGALLY) FOR 7YRS, WHEN HE LEFT WE HAD A PAPER WRITTEN UP AND NOTARIZED THAT WHEN HE LEFT HE WOULD NOT RETURN FOR ANYTHING WITHIN THE MARRIAGE, CAN THIS BE MY ACE IN THE HOLE WHEN WE GET A DIVORCE? ONLY IF HE TRIES TO TAKE ANYTHING THAT I HAVE EARNED AFTER WE HAVE BEEN APART. HE ABANDONED ME AND ALL HIS BELONGINGS TO BE WITH ANOTHER WOMAN, SO I MADE HIM SIGN THIS PAPER TO PROTECT MYSELF. NOW WITHOUT HIM I AM A 2.5 YR BUSINESS OWNER, JUST WANT TO MAKE SURE HE CANT COME IN AND CLEAN HOUSE ON MY LIFE 7YRS LATER.
You do not need to have any papers to be separated. You can file for a divorce in Virginia if you have been separated for more than a year. The written document you have may well help in a divorce. It is just hard to me to say for sure without seeing the document, but it may undervut ny claim he may make now for someting wehich he previously gave up. However, a writing that he does not want anything from you may not help if you want something from him such as support, etc. It all depends on what the paper says and what you hope to receive.
