It is legal for the bee keeper to offer less, but you don't have to accep it...you always retain the option of suing if offered less than the damages you suffered. Of course, when deciding whether or not to sue, you should weight the cost, time, and inconvenience of a law suit in the mix; if the offered amount is close to your damages, you might want to accept it.
