84 year old being charged for towing and storage in May 2009 on a car he sold 5 years ago.Did not know about liability releases. Can he fight this?

Question Details: My father has dementia, he doesn't remember if he sold or gave away the car. He signed the title, apparently didn't know about having to file a release of liability. Now the car was apparently abandoned and towed in another town and whomever had it had not turned in the title so my dad still shows as owner. Can he fight this liability, it's $1600 and he doesn't have the money.

Sure he can fight it.  Here are a couple of ideas.  First idea:  go to the department of motor vehicles and see if you can obtain a title search on the vehicle.  It might show who registered the car in the last 5 years.  Another idea, did your dad get a replacement car?  If so, he could show his insurance to prove that he no longer owned the car.  Third, you can file a release of liability form now, dating back to the date he sold/gave the car away.  Finally, you can simply tell the tow co. that he did not own the car having disposed of it 5 years earlier.  Good luck.
