1st DWI charge & vehicle accident. BAC .098
Question Details: I'm on arraignment to appear in court in a couple of weeks. It's my 1st DWI charge, I'm free on a $2,000 bailbond right now, and they are charging me with moving violation (because the vehcile was after the vehicle accident, but I thought it was Louisiana state law to move your vehicle if it becomes a hazard to other motorists), failure to yield because it was a vehicle accident (I wasn't going fast, turned out of a convenient store parking lot and a vehicle sped up to get in the middle turning lane and that made me T-bone his truck), and 1st DWI. What will happen to me in court? BAC .098
I am a lawyer in CT and practice in this area of the law. usually, states have first time offender programs that allow you to do certain alcohol education classes and the charge is ultimately dismissed. I suggest calling the public defender to determine if your state has such a program. I would also recommend that you hire a laywer to help you in this case to make sure the charge is dismissed since you are a first time offender. you should not get any jail time. if you wnt to get a lawyer and do not have enough time before the court date, go to court and ask for a few weeks to hire a lawyer. the state will allow you to do this.
