16 year old son was backing friends vehicle (the passenger) & backed into car. Do we have to file a claim w/ins co, or just pay out of pocket. KANSAS

I am a lawyer in CT and practice in this area of the law. It is always better to pay out of your pocket if you can as the insurance company will not get word of the incident and will not increase your insurance rate. I suggest trying to make a deal to pay out of pocket as opposed to making a claim. Generally, the owner of the car's insurance is going to be primarily liable for making the payment.
